The Administrator declares that he processes Users’ personal data in accordance with (GDPR) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of personal data.

What data are we talking about?

This is about personal data that we collect and process: Name and surname, e-mail address, telephone number, company registration data, order history, payment history.

In the event of logging in to the Website via a Facebook or Google account, the Administrator will gain access to the User’s personal data contained in his public profile held in a given account. The scope of available data is governed by the external portal and your privacy settings.

Subscription to the newsletter requires entering the name and e-mail address in the form. These fields are mandatory. The data obtained in this way is added to the mailing list.

 

Why do we want to process your data?

The User’s personal data is processed in order to:

  • Conclusion and performance of a contract for the provision of electronic services – if the User uses such services.
  • Respond to messages sent via the form from the Website.
  • Sending information and marketing offers, surveys, invitations and correspondence via e-mail, SMS messages, RCS messages, WEBPUSH notifications, telephone calls or postal mail.
  • Profiling, which helps to customize messages and offers according to the User’s interests.
  • Conclusion and performance of the sales contract.
  • Consideration of possible complaints.
  • Accounting documentation.

The transfer of personal data is voluntary, but it is a condition for concluding a contract for the provision of electronic services. By not providing personal data, the User loses the ability to provide services by the Administrator and loses the ability to conclude and perform the sales contract.

Personal data, on the basis of a separate consent, may also be used for other purposes. In this case, these purposes are always specified in the content of the consent. The user voluntarily decides to receive marketing content. Failure to provide personal data for marketing purposes results in not receiving such content.

 

What are the legal grounds for processing your data?

The legal basis for the processing of Users’ personal data is:

  • The requirement to process data in order to conclude and perform a contract for the provision of electronic services.
  • The legitimate interest of the Administrator, consisting in handling correspondence and responding to messages sent
  •  In the event that the User expresses a desire to receive marketing content regarding the Administrator – the necessity of data processing to achieve the goals resulting from the legitimate interests pursued by the Administrator, i.e. to carry out marketing activities regarding the Administrator. The administrator does not provide for the transfer of personal data to a third country.
  • The necessity of processing in order to conclude and perform the sales contract, including to consider any complaints.
  • In the case of the purchase of Goods – the necessity to fulfill the legal obligation resting on the Administrator, consisting in keeping accounts.

 

For what period do we store your data?

We store personal data for the period of using our services by the User. After ceasing to use the services, the User’s personal data in the scope of: name, surname, e-mail address, telephone number will be stored for a period of 2 years for the purpose of considering complaints and claims related to the use of these services.

Personal data processed in order to respond to messages sent via the contact form – will be stored for a period of 2 years from each message received. Personal data processed in order to conclude and perform the sales contract, including consideration of complaints, keeping the Administrator’s accounting – are stored until the expiry of the limitation period for the Administrator’s tax liabilities.

 

Your User Rights

The user has the full right to decide to what extent his personal data will be used. The User has the right to:

  • request access to your personal data,
  • rectifying them,
  • deletion or restriction of processing,
  • data transfer,
  • the right to object at any time to the processing of the User’s personal data, including profiling and direct marketing, withdrawal of consent to the processing of personal data at any time, if the User’s personal data is processed on its basis; withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of this consent before its withdrawal, lodge a complaint with the supervisory body, i.e. the President of the Office for Personal Data Protection.

The user may at any time withdraw consent to receive marketing content. It is enough to use the mechanisms available with marketing content, e.g. clicking on the unsubscribe link or by contacting the Administrator.

 

Who do we transfer your personal data to?

The Administrator, by collecting personal data, allows direct access only to authorized Employees, Subcontractors and Entities providing services to the Administrator (i.e. accounting, legal, auditing, IT and technical support services) and only to the extent necessary for the implementation of services commissioned by the Administrator.

Users’ personal data may be transferred to entities authorized to receive them under applicable law, in particular to the competent judicial or law enforcement authorities.

Access to the Ordering Party’s personal data is also available to entities delivering the ordered Goods – to the extent necessary to perform this delivery, as well as entities with the help of which the Ordering Party makes payments for the Goods – to the extent to which the Ordering Party provides them with this data and in accordance with the Administrator’s guidelines.

Your personal data, as a rule, are not transferred outside the EEA (European Economic Area). However, the transfer of your personal data outside the EEA may take place when it is necessary to provide your service, including when the performance of the service requires the participation of Subcontractors with registered offices outside the EEA.

Personal data is stored in a database in which technical and organizational measures have been applied to ensure the protection of the processed data adequate to the validity of the stored personal data in accordance with industry standards and guidelines of the relevant authorities, in particular with the GDPR.
